Guidance information and codes of practice help us to comply with the statutory regulations. 

Duty of Care Regulations outline a transfer note system from which the Environment Agency can trace the destination of waste and previous holders. The information required on a transfer note is illustrated in Eigure 17.2. In order to comply with the statutory duty of care in respect of waste the following procedures are advised in a Code of Practice ... 

Act or a regulation is alleged, the fact that the code was not followed will be accepted in court as evidence of failure to do all that was reasonably practicable. A defence would be to prove that something equally as good or better had been done (s. 17(2)). To supplement the Approved Codes of Practice, the Executive issue guidance booklets and notes which are purely advisory and have no standing in law but do indicate means for complying with statutory requirements. 

A safety adviser and/or the fire safety manager to provide guidance on statutory requirements, regulations, codes of practice and safe systems of work, capable of interpreting and suggesting methods of compliance and implementation.
