Neither Party shall be liable to the other Party or shall be in default of its obligations hereunder if such default is the result of war, hostilities, revolution, civil commotion, strike, epidemic, accident, fire, wind, flood or because of any act of God or other cause beyond the reasonable control of the Party affected. The Party affected by such circumstances shall promptly notify the other Party in writing when such circumstances cause a delay or failure in performance ( a Delay ) and where they cease to do so. In the event of a Delay lasting for [... insert number...] weeks or more the non-affected Party shall have the right to terminate this Agreement immediately by notice in writing to the other Party. 

As the Second World War drew to a close, government pesticide regulators saw that a new insecticide law was needed. The Food and Drug Act of 1938 had rewritten the law on residues, but otherwise the 1910 Insecticide Act remained the governing statute. With a flood of synthetic compounds ready to hit the market at war s end, chemical manufacturers were about to set in motion a force that could not be controlled by the competitive marketplace. 

The use of foam with the injected C02 causes it to act in the reservoir like a thickened fluid and probably offers the best hope for mobility control in C02 floods.
