Waxman Bill

Legislation with a similar focus has been proposed under the auspices of the Senate Environmental Committee, and introduced in a number of bills in the US Congress in recent years. These have included the Cardin-Waxman bill (1990) which proposed the funding of lead abatement projects from punitive taxes on refined lead production and battery imports ... 

For example the Reid-Lieberman bill (1991) dealing with lead in paint and solders the Waxman bill (also 1991) banning lead use in pipes and piping and the Senate and House Lead Exposure Reduction Acts of 1992 1993, which in addition to further restrictions on lead use, required inventories to be drawn up of lead-containing products (with over 0.1 per cent lead).

In an unusual instance of cooperation across parties, Waxman cosponsored a bill in 1984 with conservative Republican senator Orrin Hatch called the Drug Price Competition and Patent Restoration Act. The bill helped consumers by making it easier and faster for less expensive generic drugs to get approval from the FDA. It helped drug companies by allowing their patents to be extended when the development and approval process took a particularly long time. 

Bills have been offered in the Congress (Markey-Waxman in 2008) to stop the building of low-tech coal plants and to require that all new plants be provided with state-of-the-art CCS. Yet, the proportion of CCS plants will remain small. By 2030 it is estimated that the proportion of CCS plants in operation will be between 9% (EIA) and 15% (EPRI) of the total.

International offsets remain controversial with some political constituencies in the USA. Nevertheless, the Waxman-Markey bill signals an openness to both significant use of international offsets (i.e. 1 billion tons/year) as well as reform of the international offset process. In particular, the development of criteria to provide credits on a sectoral basis could be an area of future collaboration between the USA and the EU. 

The Senate s Clean Energy Jobs and American Power Act of 2009 (S. 1733, known as the Kerry-Boxer Bill) would establish a cap-and-trade system to reduce greenhouse gases. Similar to the House Waxman-Markey Bill, this legislation would not be expected to directly affect...
