Sherman Antitrust Act

Mack Manufacturing, the truck company. Over the next decade, the group took control of almost 40 transit companies located in 14 states. It also acquired a controlling interest in several other companies located in four additional states. In 1947 a grand jury indicted the company for violating the Sherman Antitrust Act (1890). 

Two district court decisions have examined the use of brand payment provisions in the settlement agreements involving Cardizem CD and Hytrin. Both courts have foimd the agreements to be per se restraints of trade imder Section 1 of the Sherman Antitmst Act. In re Cardizem CD Antitrust Litigation, 105 F.Supp.2d 618, 684 (E.D.
