A fair quality of goods and services

The Sale of Goods Act only covers contracts of sale. Comparable duties are imposed in contracts which are closely related to sale under the provisions of the Supply of Goods (Implied Terms) Act 1973 ° (hirepurchase contracts) and the Supply of Goods and Services Act 1982 (contracts of hire or contracts where services and goods are supplied, such as the installation by a gas company of central heating). [Pg.127]

Under the provisions of the Sale and Supply of Goods to Consumers Regulation which implement EU Directive 1999/44/EC, a relevant circumstance when deciding if goods are of satisfactory quality is any public statement on the specific characteristics of the goods made by the seller, the producer or their representative particularly in advertising or on labels. Since this could make an entirely innocent seller responsible for the content of an advertisement they had not seen and over which they had no control, they can demonstrate their innocence by showing  [Pg.127]

The Supply of Goods and Services Act requires that all who offer a service must provide that service with reasonable care and skill. It also states that if no time is agreed for the performance of the service, it must be carried out within a reasonable time, and if no charge for the service is agreed in advance a reasonable price must be paid.
